Terms and conditions

The rules for using FormaNativa: what we offer, what we expect from you and how payments and cancellation work.

Who provides the service

FormaNativa is a service operated by the individual identified below. In these terms, “FormaNativa”, “we” or “us” refer to that provider, and “you” to whoever uses the service.

Acceptance

By creating an account or using FormaNativa you accept these terms and our Privacy notice. You must be of legal age to enter into a contract. If you use the service on behalf of a company, you declare that you have the authority to bind it.

The service

FormaNativa is a platform for creating, hosting and publishing websites. Pages are created and modified with an MCP-compatible artificial intelligence assistant —such as Claude or ChatGPT— that you connect. In the studio you review the code, see the preview, publish, connect domains, manage files, forms and bookings, and go back to earlier versions.

The artificial intelligence assistant is not part of FormaNativa: you contract it with its provider, under its own terms and prices. The changes your assistant makes are saved as revisions and are only published when an administrator of your team decides so.

Your account and your teams

  • You are responsible for keeping your credentials secure and for the activity that takes place in your account and in the teams you administer.
  • We recommend that you use passkeys or turn on two-step verification.
  • The administrators of each team decide who gets in, what is published and which assistants are connected.
  • If you detect unauthorized access, tell us immediately at soporte@formanativa.mx.

Your content

Your content is yours. You grant us a limited, non-exclusive and free of charge license to host it, copy it, process it and display it only to the extent necessary to provide you the service: to keep revisions, generate previews and thumbnails, publish it at the addresses you choose and verify it automatically while it is published, as explained in Verification of published content. The license ends when you delete the content, except for the backup copies, which are overwritten over time.

You declare that you hold the rights over what you publish —text, images, trademarks and code— and that it does not infringe third-party rights. We do not use your content to train artificial intelligence models.

Acceptable use

You may not use FormaNativa to:

  • Publish illegal content or content that infringes copyright, trademarks or the privacy of third parties.
  • Impersonate people, brands or institutions, or create pages to obtain passwords or payment details by deception.
  • Distribute malicious software, spam or fraudulent content.
  • Publish content that exploits or endangers minors, incites violence or promotes discrimination.
  • Collect personal data without the privacy notice and the consent that the law requires.
  • Attempt to breach the platform, overload it or access other people's accounts.

If we detect a use that breaks these terms, we may take the content down from publication or suspend the site or the account, following the procedure in the next section.

Verification of published content

To detect and take down content that breaks the law or these terms, we automatically verify only published content: the pages anyone can open on the internet, with the text, images and files they show.

Your communications are not verified. The verification never reads form answers, bookings, emails or any other message between your site and your visitors, nor your drafts, unpublished versions, previews or password-protected pages.

  • Review by a person: no content is taken down on the automatic decision alone; a person reviews every flagged page.
  • Takedown and notice: if we confirm that the content breaks the law or these terms, we take it down from publication and let you know by email with the reason, so that you can correct it and publish it again. If the breach is serious or repeated, we may suspend the site or the account.
  • Your content is kept: taking content down from publication does not delete it from your account, unless a competent authority orders otherwise.
  • Clarifications: if you do not agree with a decision, reply to the notice or write to us at soporte@formanativa.mx and we will review it again.

We also handle reports from third parties and orders from competent authorities. If you find illegal content on a site published with FormaNativa, write to us at soporte@formanativa.mx with the address of the page and the reason.

The verification is a supporting measure and may not detect every piece of illegal content. It does not replace your responsibility for what you publish.

Forms, bookings and your visitors' data

If you use forms or bookings on your sites, you are the data controller for your visitors' personal data and FormaNativa acts as your processor. It is up to you to:

  • Publish your own privacy notice and obtain the consents that apply.
  • Ask only for the data you need and, if you request sensitive data —for example, health data—, have the express consent that the law requires.
  • Handle your visitors' requests about their data and delete their answers when appropriate.

Those answers are private: they do not go through the verification of published content and no one at FormaNativa looks at them, unless you ask us to in order to give you support or a competent authority orders it under the law. We process that data only to provide you the service, under our Privacy notice.

Prices and payments

  • The current prices are on Pricing, in Mexican pesos, IVA (Mexican value added tax) included and per site per month.
  • Your subscription is charged in advance every month by card through Stripe and renews automatically until you cancel it.
  • If you give us your tax details, we issue the CFDI (Mexican electronic tax invoice) for your payments.
  • If we change the prices, we will let you know by email at least 30 days in advance; the new price will apply from the following period.

Cancellation and non-payment

You can cancel your subscription whenever you want from the studio. The site stays published until the end of the period you paid for and after that it stops being published; your content is kept in your account until you request that we delete it. We do not make pro-rata refunds for partial periods, except where the law requires it.

If we cannot collect a payment, we will let you know so that you can update your payment method. If it is not settled after a grace period, we may suspend the publication of the site; the content is kept and the site becomes available again once the payment is settled.

Availability and changes to the service

We work to keep FormaNativa continuously available, but we do not guarantee that it will run without interruptions: there may be maintenance work or failures at providers such as Amazon Web Services, Cloudflare or Stripe.

We may improve, change or withdraw features. If a change significantly affects what you contracted, we will let you know in advance.

Liability

We provide the service diligently. To the extent the law allows, FormaNativa is not liable for indirect damages, loss of profit or loss of information arising from the use of the service, from your content, from the artificial intelligence assistants you connect or from third-party services. Our total liability towards you is limited to what you paid for the service in the 12 months before the event that gives rise to it.

Nothing above limits the rights granted to you by the Ley Federal de Protección al Consumidor (Mexico's federal consumer protection law).

Changes to these terms

We may update these terms. We will publish the new version on this page with its date and, if the change is significant, we will let you know by email before it takes effect. If you do not agree, you can cancel your subscription.

Governing law and contact

These terms are governed by the laws of the Estados Unidos Mexicanos (the United Mexican States). If you are a consumer, you may turn to the Procuraduría Federal del Consumidor (Profeco, Mexico's consumer protection agency). Any dispute falls under the jurisdiction of the courts of Guadalajara, Jalisco.
